Article 1: Definitions
In these terms and conditions, the following definitions apply:
- Campsite Operator: Hof van Philipsland, located at Oudeweg 5, 4675 PK Sint Philipsland, registered with the Chamber of Commerce under number 91480035.
- Guest: The main booker who enters into the accommodation agreement online via the booking system with the Campsite Operator.
- Co-Guest: The persons staying on the premises together with the Guest and making use of the facilities.
- Agreement: The agreement concluded online between the Campsite Operator and the Guest for the use of accommodation (camping pitch, motorhome pitch, Tiny House or B&B room).
Article 2: Formation of the Agreement
- The Agreement is concluded digitally at the moment the Guest has fully completed the online booking process via the booking system, has accepted the terms and conditions, and the payment has been successfully completed.
- Upon successful completion of the online booking, the Guest automatically receives a booking confirmation by email. This confirmation also serves as proof of the Agreement.
- The Guest is responsible for providing correct contact and personal details during the online booking process.
Article 3: Rates and Prices
- The agreed price is based on the rates displayed in the online booking system at the time of booking for the selected period and the stated number of guests.
- All listed prices include VAT. Tourist tax is shown as a separate item during the booking process and charged accordingly.
- Changes in government levies may be passed on to the Guest at any time.
Article 4: Payment Terms
- Payments are made exclusively via the payment methods offered within the online booking system (including iDEAL, credit card, Apple Pay and Google Pay).
- When booking online, the Guest must pay 100% of the total accommodation cost immediately to guarantee the reservation.
- If the payment is not completed successfully, no Agreement is formed.
Article 5: Cancellation Policy
Cancellations must be communicated to the Campsite Operator by email (info@hofvanphilipsland.nl). In the event of cancellation, the Guest owes the following percentages of the total agreed accommodation cost:
- Cancellation up to 30 days before the arrival date: 15% of the total accommodation cost
- Cancellation from the 30th day to the 14th day before the arrival date: 50% of the total accommodation cost
- Cancellation from the 14th day to the 7th day before the arrival date: 75% of the total accommodation cost
- Cancellation within 7 days before the arrival date or in the event of early departure/no-show: 100% of the total accommodation cost
The Campsite Operator strongly advises the Guest to take out appropriate cancellation insurance.
Article 6: Arrival and Departure
- The accommodation is available from 14:00 on the day of arrival.
- On the day of departure, the accommodation must be vacated by 11:00 at the latest, left clean and free of waste.
- If the Guest is unable to arrive on the scheduled date due to unforeseen circumstances, this must be communicated to the Campsite Operator as soon as possible. The reserved pitch will be held for a maximum of 24 hours, unless otherwise agreed.
Article 7: Rights and Obligations of the Campsite Operator
- The Campsite Operator makes the agreed accommodation available to the Guest and their Co-Guests for the reserved period, provided payment has been made correctly.
- In the event of force majeure (including extreme weather conditions, government measures or serious technical failures), the Campsite Operator is entitled to dissolve the Agreement or offer an equivalent alternative. In the event of dissolution due to force majeure, the accommodation cost already paid will be refunded; there is no entitlement to additional compensation.
Article 8: Code of Conduct and House Rules
- The Guest and Co-Guests are required to comply with the house rules set by the Campsite Operator. These rules relate to, among other things, quiet hours, pets, waste disposal and parking. The house rules are available on the website and on-site.
- In the event of repeated or serious violation of the house rules, or causing serious nuisance, the Campsite Operator has the right to terminate the Agreement with immediate effect and deny the Guest and Co-Guests access to the premises. In such cases, no refund of the accommodation cost will be provided.
Article 9: Liability
- The Campsite Operator accepts no liability for theft, loss, damage or injury of any kind suffered by the Guest, Co-Guests, their belongings or camping equipment during or as a result of their stay, unless caused by intent or gross negligence on the part of the Campsite Operator.
- Use of the facilities, playground equipment and the premises is entirely at the Guest’s and Co-Guests’ own risk.
- The Guest is jointly and severally liable for all damage caused by themselves, Co-Guests or their pets to property of the Campsite Operator or property of third parties on the premises.
Article 10: Amendments and Applicable Law
- Amendments to the Agreement (such as changing dates) are only valid if confirmed by the Campsite Operator. Amendment fees may apply.
- The Agreement and these terms and conditions are exclusively governed by Dutch law.
- Any disputes arising from this Agreement shall be submitted to the competent court in the district of Zeeland-West-Brabant.
